I have this great idea but in the process i found that what i wanted to patent had already been patented. Now to go on with this product i need that patent. What are the procedures i need to take to gain the patent and avoid the company turning me down or even taking my idea to the market.

Most companies aren’t terribly interested in selling their patents – but they may be willing to licence the idea to you for a flat rate or % of sales. Get your lawyer to contact their lawyers – if they’re a large company you’ll want to speak to their patent or licencing lawyers. I’d suggest making sure your lawyer should be one who specializes in patent laws, or find another one who is.
